General Terms and Conditions (GTC)

The following regulations regarding the conclusion of the contract apply to orders with Vestibule GmbH, St. Peterstrasse 20, 8001 Zurich (“Vestibule”). As part of the ordering process, you accept these conditions in the version valid at the time of the order. The imprint is part of the terms and conditions.

Prices

Prices in foreign currencies are non-binding guidelines. The binding prices are stated in CHF.

Conclusion of the contract and delivery

All items and prices published in the online shop are considered an offer. However, this offer is always subject to the condition of incorrect pricing or an impossibility of delivery.

The contract is concluded as soon as the customer places his order completely and also confirms the general terms and conditions. The order is confirmed to the customer by an automatically generated order confirmation to the email address provided by the customer.

This order confirmation is not a binding promise that the ordered items are actually available or can be delivered. This means that the customer only receives the information that the order has arrived at Vestibule. The contract is only concluded through the products expressly listed in the shipping confirmation, which ultimately determines the scope of services.

The ordered products will be delivered as soon as full payment has been received by Vestibule.

The customer is entitled to withdraw from the contract if, after conclusion of the contract, products cannot be delivered either in whole or in part for reasons for which Vestibule is not responsible. In this case, purchase prices already paid will be refunded by Vestibule.

When the ordered product is handed over to the transport company, Vestibule's obligation to deliver is fulfilled. The risk of loss of the ordered product passes to the consumer when the ordered product is shipped. Vestibule is not liable for errors made by the transport company used.

Price and shipping costs

The prices stated at the time of the ordering process apply. The prices stated are final prices, i.e. H. they include the applicable statutory VAT.

Shipping costs, customs duties and all other costs incurred are not covered by Vestibule and are to be borne in full by the customer, unless expressly stated otherwise.

payment

Payment can be made either by credit card, TWINT; Paypal or invoice. Gift vouchers that were not purchased on the Vestibule website cannot be used for payment on this website.

Purchase on account with partial payment option (POWERPAY)

MF Group / POWERPAY, as an external payment service provider, offers the payment method “purchase on account”. With the individual invoice you can easily pay for your online purchase by invoice. If you decide not to pay within the specified time frame, you will subsequently receive a monthly invoice with an order overview in the following month.

When the purchase contract is concluded, POWERPAY takes over the invoice claim and handles the corresponding payment terms. When purchasing on account, you accept POWERPAY 's terms and conditions in addition to our terms and conditions.

Local pickup with payment method “purchase on account”

If you have chosen the payment method "purchase on account" for an order with local pickup in the store, we require a signature and a copy of a valid ID upon pickup due to the guidelines of our partner company POWERPAY.

Return policy

We hope you are satisfied with your order. If this is not the case, Vestibule grants you the right to return the goods within 14 days of receiving the goods. The right of return only applies to unworn, unwashed and flawless items from which the tags have not been removed. Shoes may only be returned with the original shoe box.

Products in the FINAL Sale (appears in the product description), gift vouchers, cosmetics, food and underwear or swimsuits cannot be returned.

If the return was purchased with a voucher, a new voucher will be issued.

Shipping costs, customs duties and all other costs for returning the products are not covered by Vestibule and are to be borne in full by the customer.

Please return products in their original packaging by post or courier to:

Or return the items to one of our stores.

Refund

Any refunds will be made to the account used for payment after inspection of the returned goods. You will be notified by email of the approval or rejection of your refund request.

After reviewing your return, we will notify you by email of the approval or rejection of your refund.

Guarantee

The delivered products must be checked as soon as possible and no later than 5 working days after receipt of the product, any defects identified must be reported to Vestibule by sending an email with a photo of the defect to customercare@vestibule.ch. Otherwise the products are considered approved.

Defects that cannot be discovered during proper inspection must be reported to Vestibule immediately upon discovery by sending an email with a photo of the defect to customercare@vestibule.ch. Otherwise, the product is considered approved with regard to these defects.

Vestibule guarantees that defects will be corrected. This is done at our discretion through supplementary performance, i.e. H. Elimination of a defect (repair) or delivery of a defect-free item (replacement delivery).

If subsequent fulfillment fails, the customer is entitled to withdraw from the contract. This does not apply to minor defects. The customer's right to a reduction in the purchase price is excluded. This exclusion of liability also applies to all claims that compete with the warranty rights.

The warranty does not cover normal wear and tear, the consequences of improper handling or damage caused by the buyer or third parties, or defects that can be attributed to external influences.

Disclaimer

The contents of Vestibule's website contain no representations or warranties. In no event shall Vestibule be liable (to the extent permitted by law) for any direct, indirect or consequential damages arising as a result of the use of information and material from this website or access via links to other websites. Liability for third-party damage is also excluded. The amount of any claim arising from Vestibule's liability is also limited to the purchase price of the product sold.

Vestibule assumes no liability for the descriptions of third parties, in particular customers within the scope of the online shop or Customer reviews published on our social media presence.

Severability clause

Should individual provisions of this contract, including these provisions, be wholly or partially ineffective or should this contract contain a gap, this will not affect the validity of the remaining provisions or parts of such provisions. The ineffective or missing provisions will be replaced by the respective legal regulations.

Applicable law and jurisdiction

This agreement and all legal relationships associated with it are subject to Swiss law. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.

The courts in Zurich, Switzerland, are the exclusive place of jurisdiction for all disputes in connection with this contract.

Changes

Vestibule reserves the right to change, update or replace any part of these Terms and Conditions at any time without notice.
