General Terms and Conditions (GTC)

The following regulations on the conclusion of the contract apply to orders with Vestibule GmbH, St. Peterstrasse 20, 8001 Zurich ("Vestibule"). During the ordering process you accept these terms and conditions in the version valid at the time of the order. The imprint is a part of the terms and conditions.

Prices

The prices in foreign currency are non-binding guide values. The binding prices are indicated in CHF.

Conclusion of the contract and delivery

All items and prices published in the online store are considered as an offer. However, this offer is always subject to the condition of incorrect pricing or impossibility of delivery.

The contract is concluded as soon as the customer places his order in full and also confirms the GTCs. The order is confirmed to the customer by an automatically generated order confirmation to the e-mail address provided by the customer.

This order confirmation is not a binding promise that the ordered items are actually available or can be delivered. The customer only receives the information that the order has arrived at Vestibule. Only through the products explicitly listed in the shipping confirmation, the contract is concluded, which conclusively determines the scope of services.

The ordered products will be delivered as soon as Vestibule receives the full payment.

The customer is entitled to withdraw from the contract if, after the conclusion of the contract, products cannot be delivered in whole or in part for reasons beyond Vestibule's control. In this case, already paid purchase prices will be refunded by Vestibule.

With the delivery of the ordered product to the transport company, the fate debt of Vestibule is fulfilled. The risk of loss of the ordered product is transferred to the consumer with the shipment of the ordered product. Vestibule is not liable for errors of the transport company used.

Price and shipping costs

The prices stated at the time of the order process shall apply. The prices stated are final prices, i.e. they include the statutory value-added tax applicable at the time.

Shipping costs, customs duties and all other costs incurred are not covered by Vestibule and are to be paid in full by the customer, unless explicitly stated otherwise.

Payment

Payment can be made by credit card, TWINT, Paypal or invoice. Gift certificates not purchased on the Vestibule website cannot be used for payment on this website.

Purchase on account with installment facility (POWERPAY)

MF Group / POWERPAY offers the payment method "Purchase on account" as an external payment service provider. With the single invoice, you can simply pay for your online purchase by invoice. If you decide not to pay within the specified time frame, you will receive a monthly invoice with an order overview in the following month.

When the purchase contract is concluded, POWERPAY takes over the invoice claim and processes the corresponding payment modalities. When purchasing on account, you accept POWERPAY's GTCs in addition to our GTCs.

Local collection with "purchase on account" payment method

If you have selected the payment method "purchase on account" for an order with local collection at Store , we require a signature and a copy of a valid ID card upon collection due to the guidelines of our partner company POWERPAY.

Right of return

We hope that you are satisfied with your order. Should this not be the case, Vestibule grants you a right of return within 14 days of receipt of the goods. The right of return applies only to unworn, unwashed and perfect items from which the labels have not been removed. Shoes may only be returned with the original shoe box.

FINAL Sale products (appears in the product description), gift certificates, cosmetics, food and underwear or swimsuits cannot be returned.

If the return was purchased with a voucher, a new voucher will be issued.

Shipping costs, customs duties and all other costs for the return of the products are not covered by Vestibule and are to be paid in full by the customer.

Please return products in original packaging by mail or courier service to:

Or return the items to one of our stores.

Refund

Any refunds will be made to the account used for payment after verification of the returned merchandise. You will be notified by email of the approval or denial of your refund request.

After reviewing your return, we will notify you by email of the approval or denial of your refund.

Warranty

The delivered products must be inspected as soon as possible and at the latest within 5 working days of receipt of the product, any defects detected must be reported to Vestibule by sending an e-mail with a photo of the defect to [email protected]. Otherwise, the products will be considered approved.

Defects that cannot be discovered during proper inspection must be reported to Vestibule immediately after discovery by sending an e-mail with a photo of the defect to [email protected]. Otherwise, the product shall be deemed approved with regard to these defects.

Vestibule guarantees rectification of defects. This is done at our discretion by subsequent performance, i.e. elimination of a defect (rectification) or delivery of a defect-free item (replacement).

If the subsequent performance fails, the customer is entitled to withdraw from the contract. This does not apply to minor defects. The customer's right to reduce the purchase price is excluded. This exclusion of liability also applies to all claims competing with the warranty rights.

The warranty does not cover normal wear and tear, the consequences of improper handling or damage by the purchaser or third parties, or defects caused by external influences.

Disclaimer

The content of the Vestibule website contains neither representations nor warranties. Vestibule is not liable (to the extent permitted by law) in any case for any direct, indirect or consequential damages resulting from the use of information and material from this website or from access via links to other websites. Liability for third party damages is also excluded. The amount of any claim arising from the liability of Vestibule is also limited to the purchase price of the product sold.

Vestibule assumes no liability for the descriptions of third parties, in particular customers in the context of customer reviews published in the online store or our social media presence.

Severability clause

Should individual provisions of this contract, including these provisions, be invalid in whole or in part, or should this contract contain a loophole, this shall not affect the validity of the remaining provisions or parts of such provisions. The invalid or missing provisions shall be replaced by the respective statutory provisions.

Applicable law and place of jurisdiction

This Agreement and all legal relations in connection therewith shall be governed by Swiss law. The United Nations Convention on Contracts for the International Sale of Goods (CISG) shall not apply.

The courts of Zurich, Switzerland, shall have exclusive jurisdiction over any disputes arising in connection with this Agreement.

Changes

Vestibule reserves the right to change, update, or replace portions of these Terms and Conditions at any time without notice.
